Part I of Chapter 489 of the Florida Statutes—“Construction Contracting” (sections 489.101 through 489.147)—lays out the regulatory framework for contractors in Florida, including the purpose and scope of the law, definitions of contractor categories, the role of the Construction Industry Licensing Board, licensure by examination, certification and registration requirements, business-organization and qualifying-agent rules, enforcement against unlicensed contracting (contracts by unlicensed contractors are unenforceable) and the establishment of the Florida Homeowners’ Construction Recovery Fund to provide a means of recovery for homeowners harmed by certain contractor misconduct.
